When making a purchase from TSM REPTILES, it is acknowledged that you accept the
following Terms and Conditions.
Your statutory rights are not affected.
The Sale:
We shall sell to you and you shall purchase only those Goods which you have set out in an Order and which has been accepted by us. We reserve the right to reject any Order. Each such sale of Goods will be subject to these Conditions.
No Order submitted by you shall be deemed to be accepted by us unless and until confirmed by e-mail or in writing by us.
No variation to these Conditions shall be binding upon us unless and until agreed by e-mail or in writing by us.
Any advice or recommendation given on this web site or otherwise given by us as to the storage, application or use of the Goods is followed or acted upon entirely at your own risk, and accordingly we shall not be liable for any such advice or recommendation.
Any typographical, clerical or other error or omission on any page of this web site or in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by us shall be subject to correction without any liability on our part.
Orders:
The quantity, quality and description of the Goods will be those set out in your Order. In the case of live insects the quantity and size are approximate.
Orders are accepted at our sole discretion but are normally accepted if the Goods are available, the order reflects current pricing.
TSM Reptiles & Exotics are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the Goods appearing on our website.
You shall be responsible for ensuring the accuracy of the terms of any Order submitted by you, and for giving us any necessary information relating to the Goods within a sufficient time to enable us to make any necessary amendments prior to dispatch of the goods.
The quantity, quality and description of and any specification for the Goods shall be those set out in the relevant pages of this site.
We reserve the right to make any changes in the specification of the Goods.
Price of the goods:
The price of the Goods shall be the price set out on the relevant page of this site. We reserve the right to change the prices set out on this site provided that if we accept an order from you the price for the goods will be the price set out in the relevant range at the time the order is placed.
In addition to the price of the Goods you will be liable to pay our charges for transport, packaging and insurance where relevant and agreed by both parties.
The total price is inclusive of any applicable value added tax at the current rate of 17.5%.
Terms of payment and refunds:
Orders will not be dispatched until payment has been made if full, this includes clearance of cheque's.
All cheque's and postal orders are to be made payable to ‘TSM Reptiles.’
Payments made through PayPal shall be paid into the account of ‘TSMReptiles@aol.com’
Most forms of credit card payments are accepted, a surcharge of £2 will be added on all orders under the value of £25. This is to cover bank expenses placed upon us and the use of terminals.
This surcharge is wavered on all orders over £25.00
Upon providing us with details of the Payment Card and submitting the Order you :
Confirm and undertake that the information contained within the Order is true and accurate and that you are duly authorised to use the Payment Card; and
Authorise us to deduct from the Payment Card account the full price of the Goods and all other payments which may become due to us under the Contract.
If it is not possible to obtain full payment for the Goods from your account prior to delivery of the Goods to you, we can cancel the Order or suspend any further deliveries to you. This does not affect any other rights we may have.
We will take all reasonable care to keep all information connected with your order secure but we cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including credit and account details you provide when accessing or ordering from this Web Site, unless this is solely due to our negligence.
Refunds will only be given at our discretion.
Delivery and Returns:
Delivery costs are that shown on the website, we reserve the right to change these prices at any time and you will be notified accordingly.
Orders are dispatched between Monday’s and Thursday’s only. A Friday dispatch is available however this will be at an additional cost to you. Please enquire about cost with us direct.
Delivery of the Goods shall be made by us or our carrier to the address for delivery shown in the Order Form. It is important that this address is accurate. Please be precise about where you would like the Goods left if you are out when we deliver. We cannot accept any liability for any loss or damage to the Goods once they have been delivered in accordance with your delivery instructions.
Orders will be sent via Royal Mail or an overnight courier service in most cases, any additional cost in these services or insurance of goods other than that stated on our website will be agreed at time of confirmation of order.
TSM Reptiles & Exotics reserve the right to delay postage of goods in the extreme of weather conditions. You will be notified at the earliest convenient time.
TSM Reptile & Exotics cannot be held responsible for any delay in you receiving the goods due to circumstances out of our control with the delivery company.
We do not accept responsibility for any loss or damage of goods during transit with an outside delivery company, i.e. Royal mail or other courier company. Should such problem arise then you will need to deal with the delivery company direct or, if you wrongfully fail to take delivery of the Goods, the time when we or our carrier has tendered delivery of the Goods.
In the unlikely event that a product needs to be returned, this will be done so at your expense. The return cost will not be refunded by TSM Reptiles & Exotics, unless prior agreed with by us in writing.
Delivery cost:
All prices are subject to change without notice, although should there be any unforeseen change in prices we will notify you prior to dispatch.
All delivery costs are as follows unless otherwise agreed by use in writing.
All livefood is priced including delivery within the mainland UK; a minimum of three tubs of livefood is required per order.
Frozen food will be shipped out by overnight door to door courier at the cost of £9.99 per order under £75, orders over this value £7.00 and orders over £125.00 will be delivered free of charge.
Dry goods will be sent by Royal Mail or overnight courier service; cost will depend on weight and will be given to you at the time of confirmation of your order.
Reptiles, Amphibians and Arachnids / insects can be shipped out by overnight door to door courier at the cost of £25 inc VAT, orders over £500 will be sent out with free delivery.
Live animals and birds can only be shipped with specialist courier companies, a cost will be applied for depending on delivery location. These companies average about 80 pence per mile
Livestock:
You must be 16 years or older to purchase livestock, unless written consent it given from an appropriate adult. And legally allowed to own/keep the animals.
You are responsible for the livestock from the point of delivery / collection. You should make all necessary provisions for the animal’s well being and care.
It is your responsibility to research the animal’s requirement and be aware of its specific needs and husbandry care.
DWA (Dangerous Wild Animals) are available for sale at our discretion. We will require proof of licence from you prior to collection.
We guarantee all our animals to be visibly healthy and feeding prior to leaving our establishment.
We guarantee the live arrival of all our live-stock, Should for any reason you are unhappy with your purchase, we will exchange or refund as appropriate. However we MUST be notified by email within 24 hours of delivery. Any return shipping costs are at your expense and will not be refunded.
Any problems incurred after the 24 hours we will endeavour to assist to the best of our ability, however cannot be held responsible for any issues after this point.
If a specific sex is required we will do our best in the supply of this as accurately as we can, however we do not give a 100% guarantee on sexing and cannot be held liable for any mistakes made.
